Welcome to The Even Keel Lodge (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website located at https://www.evenkeelbv.com/ (the “Site”) and apply to any lodging reservations or inquiries made with us.

By accessing or using our Site or making a reservation at The Even Keel Lodge, you agree to be bound by these Terms. If you do not agree, please do not use our Site or book a stay with us.
 

1. Website Usage

  • Eligibility: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use this Site and make lodging reservations.

  • Accuracy of Information: You agree to provide accurate, current, and complete information during the booking process or when communicating via the Site.

  • Prohibited Conduct: You may not use this Site for any unlawful purpose, to transmit malicious software, or to interfere with the proper functioning of the Site or our reservation systems.
     

2. Lodging Reservations & Payments

  • Third-Party Booking Services: Reservations initiated through our Site may be processed via third-party booking engines or platforms (e.g., Airbnb, VRBO, or direct booking processors). Your transaction will be subject to the terms, conditions, and privacy policies of those respective third-party payment providers.

  • Payment Terms: Full payment or deposit policies are specified at the time of booking. By submitting payment information, you authorize us (or our third-party processing partner) to charge the designated amount for your reservation.

  • Cancellations & Refunds: Cancellation policies, refund eligibility, and modification rules are detailed during the booking process and in your reservation confirmation email. Please review these carefully prior to confirming your stay.
     

3. Lodge Rules & Guest Policies

Guests staying at The Even Keel Lodge (including The Crow's Nest Penthouse Suite, The Hygge Studio, and The Skadi Studio) must abide by all posted property rules, including but not limited to:

  • Check-In / Check-Out: Check-in and check-out times must be strictly adhered to unless prior written approval is granted.

  • Occupancy Limits: Maximum guest limits per suite must not be exceeded.

  • Commercial Premises Notice: The Even Keel Lodge is located above a restaurant/bar (The Buena Viking). Guests acknowledge that normal operational noise, music, and restaurant activity may occur during operating hours.

  • No Smoking / Property Damage: Smoking is strictly prohibited inside the lodge suites. Guests are responsible for any property damage, missing items, or excessive cleaning required as a result of their stay.

  • Pets: Pets are only permitted if explicitly designated in your booking agreement or property policy.
     

4. Intellectual Property

All content on this Site—including text, photos, logos, graphics, brand names (such as "The Even Keel Lodge"), and layout—is the property of The Even Keel Lodge or its licensors and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from any Site content without express written consent.
 

5. Third-Party Links

Our Site may contain links to third-party websites or services (e.g., local attractions, restaurants, or payment portals). We do not control or endorse these external sites and are not responsible for their content, policies, or practices.

Our total liability for any claim related to your stay or use of the Site shall not exceed the total amount paid by you for your reservation.
 

8. Indemnification

You agree to defend, indemnify, and hold harmless The Even Keel Lodge, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any property rules during your stay.
 

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Chaffee County, Colorado.
 

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or booking of accommodations following any modifications constitutes acceptance of the updated Terms.
